Oftentimes, Third-Party Surplus Funds Recovery Companies will send a former Homeowner a document known as an “Assignment of Interest.” However, what the former Homeowner doesn’t know is that this document effectively assigns away their right to the surplus funds to the Third-Party Company. Once this has occurred, it can be difficult to recover said rights, and once the funds are disbursed to the third-party company there is no way to get them back into the Court’s registry.
