Florida Tax Deed Sale Surplus Funds Lawyer: Important Notes

Not every tax deed surplus case is the same. I have handled cases that are as simple as providing a correct statement of claim, and I have also handled tax deed surplus funds cases that require probate, litigation and much more. The question is, does your tax deed surplus lawyer know what needs to be done?

Through vast experience, I have come to the conclusion that every tax deed case is different. So much of your Florida tax deed surplus case will depend on two factors, 1) what Florida county is your tax deed surplus located in; and 2) are there any lien holders. These two factors will determine the course that you need to take on the file.

Let me show you an example: Homeowner makes a claim for the tax deed surplus funds. The county states that there is a mortgage lien that has not made a claim for the funds. The county refuses to issue the funds to the homeowner (no matter how long it has been). This is because in tax deed surplus cases in Florida, if there are any lienholders that don’t make a claim, even though the homeowner has, the county clerk is not allowed to disburse the funds. So, what can the homeowner do to get the funds?

If takes some pushing, but often we can get the county clerk to initiate what is called an Interpleader case. However, some counties refuse to initiate an Interpleader, and therefore the homeowner will have to initiate its own case via a declaratory action lawsuit.

Point being, if there are any lien holders that have failed to make a claim before the homeowner, the homeowner WILL have to go to court. Don’t delay. Get the case into court or nothing is going to happen with those surplus funds.
